Terms and Conditions
These Terms and Conditions are written for the safety and security of both Trainer and Client. This agreement is between you as the client and New Age Active as a company. Upon starting your fitness training with a Trainer from New Age Active you are entering into a contract with them.
You commencing your personal training with a Trainer will constitute acceptance of these Terms and Conditions. This does not affect your statutory rights.
The Trainer will provide coaching support, supervision, information and advice that will aid you to achieve your fitness goal.
The Trainer will use his or her skill set, knowledge and experience to design a safe programme of exercise. This programme will be based on your physical profile, lifestyle, fitness goals, exercise level and any medical conditions you may have.
You understand that the results of any fitness programme cannot be guaranteed. The results will depend on your effort and co-operation in and outside of the fitness sessions. You also acknowledge that individual results may vary from person to person and no particular result can be guaranteed by your Trainer.
All Client information will be kept strictly private and confidential.
You are required to arrive on time for each Session so that the Trainer’s full training plan is achieved on each visit.
It is understood between you and your Trainer that both must commit to your training programme 100% in order for you to achieve progress and results.
You are required to complete a Physical Activity Readiness Questionnaire (a “PARQ”) before undertaking your first personal training session. This will be provided.
Depending on what you disclose within the PARQ the Trainer may require a letter of ‘medical clearance’ from your GP. Please be aware that your GP may charge for providing this letter.
You are required to wear appropriate clothing and footwear which is comfortable and durable.
You understand and agree that it is your responsibility to inform the Trainer of any conditions or changes to your health, now and ongoing. As this may affect your ability to exercise safely and with minimal risk of injury.
You understand that there are risks in participating in a programme of strenuous exercise. If you sustain or claim to sustain any injury while participating in a training session, you acknowledge that the Trainer is not responsible; except where the injury was caused by his/her gross negligence or an intentional act.
Your Trainer cannot be held liable in any way for undeclared or unknown medical conditions.
Cancellation and Refunds
You understand that a 24 hours notice of cancellation or postponement is required for all appointments. Less than 24 hours may incur full payment of the full Session fee.
Once fully purchased, your Sessions are non-refundable and non transferable. Unless both trainer and client mutually decide to end the fitness programme.
If the Client is late to an organised Session, the Session cannot be extended and will end at the agreed appointed time.
If the Trainer is late to an organised session, additional time will be added to the Session or to subsequent Sessions.
Health and Safety
Both trainers at New Age Active have completed and holds a current certificate for Emergency First Aid at work approved by the Health and Safety Executive, which will be assured to stay up to date every year.
Both trainers at New Age Active have public liability insurance cover.
If your Trainer conducts the Sessions on your premises you are responsible for providing a safe exercise environment.
You are responsible for keeping all your contact information and marketing preferences up to date with the Trainer.
You understand that in the event of your Trainer being unable to continue your training, you can request a full refund from your Trainer for any unfulfilled Sessions.
In order to comply with the Data Protection Act 1998, the Trainer will only do what you ask, or what you have given permission to do with any personal or sensitive information held.
New Age Active has the right to change these Terms and Conditions, for example, to be able to offer new services or as required by law. You will be notified you of any change. When such a change(s) is made, if dissatisfied you can cancel this agreement once you have made any payments already due to the Trainer.
This agreement is governed by the laws of England and Wales and is subject to the jurisdiction of the English courts.
